"What Employers Need To Know About Electronic Document Retention"

On April 24th and 26th, 2007, Schwarzberg & Associates will be presenting the first of its 2007 Employment Law Seminar Series, and the topic is one which applies to all employers alike.

The first seminar will address:

  • Employers need to have a data retention policy for electronically stored information – and follow it
  • What kind of documents do employers need to retain, and for how long?
  • What obligations do employers have in responding to e-discovery, and who bears the costs?
  • Failure to disclose data or comply with discovery can have dire consequences in litigation
  • How can confidential files, customer databases, or proprietary information be protected?

Due to new developments in the law, employers face new or increased requirements when it comes to litigation and the resulting discovery of electronically-stored information (ESI), including e-mail, Word files and databases. The failure to preserve ESI, even if inadvertent, can result in sanctions or even adverse jury instructions -- potentially crippling the defense of a case.

Employers must take steps both before and during litigation to ensure that data which may be used to support any claims or defenses is adequately preserved. The new rules suggest that every employer should have a Document Retention Policy in place and tailor that policy to ensure a “Litigation Hold” is put in place once the employer reasonably anticipates litigation. A written ESI retention policy that is maintained and adhered to as part of the employer’s standard policies and practices will ensure that all relevant documents are preserved for discovery and trial. Subsequent seminars on other topics will be held on the fourth Tuesday and Thursday of each month in May, June, September and October.
